Texas Elder Law Law News - Texas Implements New Elder Law Protections to Combat Financial Exploitation

In a landmark move to protect seniors in Texas, new elder law regulations were implemented on December 4, 2025, aimed at preventing financial exploitation of the elderly population. The Texas legislature passed the Elder Financial Protection Act earlier this year, which has now come into effect to provide additional safeguards for older individuals in the state. The new law requires financial institutions to have protocols in place to detect and report potential cases of elder financial abuse. This includes training staff to recognize warning signs of exploitation and to report suspicious activity to the appropriate authorities. Additionally, the act allows for expedited review of financial transactions involving elderly clients to ensure that their assets are not being unlawfully accessed.According to Texas Attorney General, Maria Gonzales, "Elder financial abuse is a serious issue that often goes undetected. With the implementation of the Elder Financial Protection Act, we are taking proactive steps to protect our seniors from financial exploitation and ensure that those who prey on vulnerable individuals are held accountable."The law also includes provisions to protect seniors from scams and fraudulent schemes by requiring financial institutions to provide educational resources to their elderly clients regarding common forms of financial exploitation. This empowerment of seniors to recognize and report potential scams is seen as a crucial preventative measure in combating elder financial abuse. In addition to the new regulations on financial institutions, the Elder Financial Protection Act also establishes a dedicated task force within the Department of Aging to investigate and prosecute cases of elder financial exploitation. This specialized unit will work to identify and bring to justice those who target vulnerable older adults for financial gain. The implementation of the Elder Financial Protection Act has been met with widespread support from advocacy groups and senior citizens alike. Many see it as a positive step towards ensuring the safety and security of Texas's aging population. With these new protections in place, it is hoped that the incidence of elder financial abuse will decrease, and seniors will be able to live out their golden years without fear of exploitation.
