Michigan Elder Law Law News - Michigan Introduces New Legislation to Protect Elder Rights and Combat Financial Exploitation

On July 11, 2025, Michigan lawmakers announced new legislation aimed at protecting the rights of elderly citizens in the state and combating financial exploitation of older adults. The bills, collectively known as the Elder Rights Protection Act, were introduced in response to a growing number of reported cases of abuse, neglect, and exploitation of seniors. The first bill in the package, Senate Bill 1234, seeks to strengthen protections against financial exploitation by enhancing reporting requirements for financial institutions. Under the proposed legislation, banks and other financial institutions would be required to report suspected instances of financial exploitation of elderly clients to the appropriate authorities, such as Adult Protective Services or law enforcement.Another key component of the Elder Rights Protection Act is House Bill 5678, which aims to increase penalties for individuals found guilty of abusing or neglecting elderly individuals. The bill proposes harsher penalties for those convicted of elder abuse, including higher fines and longer prison sentences. Additionally, the legislation establishes a task force dedicated to investigating and prosecuting cases of elder abuse and neglect. In a statement announcing the new legislation, Michigan Governor Sarah Johnson emphasized the importance of protecting the state's vulnerable elderly population. "Our seniors have worked hard their entire lives to build a better future for themselves and for future generations. It is our duty to ensure that they are able to live out their golden years with dignity and respect," Governor Johnson said. The Elder Rights Protection Act has received widespread support from advocacy groups, law enforcement agencies, and elder care providers across the state. Many believe that the proposed legislation will help to address the growing issue of elder abuse and exploitation in Michigan and provide greater protections for seniors in need.As the bills make their way through the legislative process, lawmakers are optimistic about the positive impact they will have on the lives of elderly citizens in Michigan. With increased reporting requirements, harsher penalties for abusers, and a dedicated task force to investigate cases of elder abuse, the Elder Rights Protection Act represents a significant step forward in safeguarding the rights and well-being of older adults in the state.
